Terms and Conditions of Sale

1. General

These Terms and Conditions of Sale (“Terms”) apply to all purchases of products made through the webshop at www.vikingarm.com (the “Webshop”), operated by Viking Arm AS. A “consumer” is a natural person who purchases products for purposes outside their trade, business, craft or profession. A “business customer” is any person or legal entity purchasing products in connection with a trade, business, craft or profession. Where a provision is expressly stated to apply to consumers, it applies only to consumers. Unless otherwise stated, these Terms apply to both consumers and business customers.

Purchases intended for resale or distribution require a separate written agreement with Viking Arm AS. Please contact us at info@vikingarm.com regarding reseller terms, pricing and availability. This does not restrict business customers from purchasing products from the Webshop for their own professional use, subject to these Terms.

By placing an order in the Webshop, you confirm that you have read, understood, and accepted these Terms in full. Together with your order and our order confirmation, these Terms form the complete contractual basis for the purchase.

If you are under 18 years old, you may only make purchases in the Webshop with the consent of, or through, a parent or legal guardian.

Buyer: The individual or legal entity identified as the buyer in the order.

Webshop: The online store operated at www.vikingarm.com.

Please note that Viking Arm AS is a Norwegian company. Norway is not a member of the EU but is part of the European Economic Area (EEA). Where these Terms grant you rights derived from EU consumer protection law (such as the right of withdrawal), those rights are provided to you on a contractual basis equivalent to the rights you would have when buying from a seller established in the EU. Nothing in these Terms deprives you of the protection afforded by mandatory consumer protection provisions of the law of the country in which you have your habitual residence, where such provisions cannot be derogated from by agreement under the applicable rules of private international law (see Section 13 below).

2. Ordering and Formation of Contract

Your order is binding once it has been registered in our systems. We are likewise bound by your order provided it does not deviate from what we have offered in the Webshop, in our marketing, or otherwise.

We reserve the right to cancel an order, or part of an order, if it deviates from what we have offered, if a product is out of stock, if there is an obvious pricing or product description error, or if there is reasonable suspicion that the order is intended for resale or distribution without a separate agreement with Viking Arm AS. You will be notified without undue delay if all or part of your order is cancelled, along with information on any alternative we may be able to offer and, where payment has already been made, a full refund of the amount paid for the cancelled item(s).

We will send you an order confirmation by email once your order has been placed. Please check the order confirmation carefully against your order and contact us as soon as possible if there are any discrepancies.

3. Prices and Payment

All product prices in the Webshop are displayed in EUR, except for customers using a Norwegian IP address, for whom prices are displayed in NOK using the WooCommerce exchange rate applicable at the time. Product prices include VAT. The applicable flat delivery charge, including VAT, and the total cost of your purchase are clearly displayed before you complete your order at checkout.

A flat delivery charge, including applicable VAT, applies to each order regardless of order size. For customers shown NOK prices, the corresponding NOK amount is calculated using the WooCommerce exchange rate applicable at the time.

VAT, duties and import charges: Prices displayed at checkout include VAT, and the total shown includes the applicable delivery charge. Where import clearance is required, orders are supplied on a Delivered Duty Paid (DDP) basis. Viking Arm AS is responsible for import formalities, import VAT and any applicable customs duties required for delivery to the destination country; you will not be asked by the carrier to pay additional import charges on delivery.

We reserve the right to correct obvious pricing errors (e.g. due to technical faults or typing errors) and to adjust or cancel affected orders. Any such correction will be made within a reasonable time after the error is discovered, and you will always be informed and given the option to cancel your order free of charge if a price increases as a result.

Available payment methods are shown at checkout. Payment is currently made by payment card. Payment is processed securely via our payment service provider(s); Viking Arm AS does not store full card details.

4. Delivery

We currently deliver to EU countries and Norway. The available delivery destinations are shown at checkout.

Estimated delivery times are shown in the Webshop and are indicative rather than binding, unless expressly agreed otherwise. A flat delivery charge including applicable VAT, applies to each order regardless of order size.

Risk of loss or damage to the products passes to you once you, or a third party designated by you (other than the carrier), have taken physical possession of the products.

If delivery is delayed, we will inform you as soon as we become aware of this, together with information on when delivery can be expected, or whether the product is out of stock. If delivery is significantly delayed, you have the right to cancel the order and receive a full refund.

Upon receipt, please inspect the shipment as soon as reasonably possible to check that it matches your order confirmation and that the products have not been damaged in transit. Please contact us promptly at webshop@vikingarm.com if anything is missing, incorrect, or damaged, and keep the packaging and product until the matter has been resolved.

5. Right of Withdrawal (Cancellation)

This Section 5 applies only to consumers. Business customers do not have a statutory right of withdrawal unless applicable law expressly gives them such a right or Viking Arm AS has expressly agreed otherwise in writing. As a consumer, you have a 14-day right of withdrawal from your purchase without giving any reason. If mandatory consumer protection law in your country of residence provides more favourable rights, those rights apply instead.

Withdrawal period: The withdrawal period expires 14 days after the day on which you, or a third party indicated by you (other than the carrier), acquire physical possession of the last product ordered.

How to withdraw: Before the withdrawal period expires, you must inform us of your decision to withdraw from the contract by a clear statement, for example by email to webshop@vikingarm.com or through our withdrawal form at https://vikingarm.com/withdrawalform. You may, but do not have to, use the withdrawal form; simply stating that you wish to cancel your order, together with your order number, is sufficient.

Returning the goods: You must send back the goods, or hand them over to us, without undue delay and in any event no later than 14 days from the day on which you communicate your withdrawal to us. The deadline is met if you send back the goods before this 14-day period has expired.

Return address – important:  Do not send webshop returns to Viking Arm AS in Norway. Webshop orders are dispatched from Sweden by our third-party fulfilment partner, Sellvibe AB. To ensure that your return is received and processed correctly, all returns must be sent to the address below, unless we have expressly instructed you otherwise.

Cost of return: For returns under the right of withdrawal, you must pay the direct cost of returning the goods unless we have agreed to cover it. This does not apply to defective or incorrect goods for which we are responsible.

Refunds: We will reimburse all payments received from you, including standard delivery costs (excluding any extra costs if you chose a delivery method other than the least expensive standard delivery we offer), without undue delay and in any event no later than 14 days from the day we are informed of your decision to withdraw. We may withhold reimbursement until we have received the goods back, or until you have supplied evidence of having sent the goods back, whichever is earlier. Reimbursement will be made using the same means of payment you used for the original transaction, unless expressly agreed otherwise, and will not incur any fees for you.

Condition of returned goods: You are liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods (i.e. handling beyond what you would reasonably do in a physical shop). Please return the product in its original packaging where possible, complete with all accessories, manuals, and documentation.

Exceptions to the right of withdrawal: The right of withdrawal does not apply where an exception is permitted by applicable law, including goods made to the consumer’s specifications or clearly personalised.

6. Statutory Rights and Manufacturer’s Warranty

Consumer statutory rights: This paragraph applies only to consumers. As a consumer, you are entitled to the legal guarantee of conformity for goods, which protects you against any lack of conformity that exists at the time of delivery and becomes apparent within the guarantee period applicable under the mandatory consumer protection law of your country of residence (in many EU/EEA countries, this is a minimum of two years from delivery, and may be longer for used or specific product categories under local law). If a product is faulty or does not conform to the contract, you may, depending on the circumstances and subject to applicable law, be entitled to repair, replacement, a price reduction, or termination of the contract. Business customers have the rights and remedies provided by applicable law and these Terms.

To make a claim, please contact us as soon as possible after discovering the defect, at support@vikingarm.com or via https://vikingarm.com/support-inquiry/, stating your order number and a description of the fault. We will confirm receipt of your claim and advise on the next steps, including any specific handling required for returning the product.

Manufacturer’s warranty: In addition to, and without limiting, any statutory rights that may apply, Viking Arm AS offers the following voluntary manufacturer’s warranty on products purchased through the Webshop:

  • Viking Arm® – The Original, purchased on or after 1 October 2024: Limited Lifetime Warranty, covering defects due to faulty materials or workmanship, subject to proof of purchase. This warranty does not cover normal wear and tear, misuse, or damage from unauthorised repairs.
  • All other Viking Arm products: 2-year warranty from the date of purchase, on the same basis.

Full terms of the manufacturer’s warranty, including exclusions, are available at https://vikingarm.com/warranty/ and in the Product Warranty Policy (PDF). The manufacturer’s warranty is additional to, and does not limit, any mandatory statutory rights that apply to a consumer.

7. Liability

To the extent permitted by applicable law, Viking Arm AS is not liable for any indirect or consequential loss arising from a defect in the goods. Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited under applicable law, including mandatory consumer protection and product liability law.

8. Your Personal Data

We process your personal data in order to fulfil your order and in accordance with our Privacy Policy, which explains what data we collect, how we use it, and your rights (including the right to lodge a complaint with your local data protection authority). By placing an order, you acknowledge that your personal data (such as name, contact details, delivery address, and payment information) will be processed for the purpose of fulfilling and administering the purchase.

9. Force Majeure

Viking Arm AS is not liable for any failure or delay in performing its obligations under these Terms to the extent such failure or delay is caused by circumstances beyond our reasonable control, including but not limited to labour disputes, fire, war, mobilisation, requisition, seizure, currency restrictions, civil unrest, shortage of transport, general shortage of goods, restrictions in the supply of fuel, and delays or defects in deliveries from our subcontractors or suppliers caused by any such circumstances. In such cases, our obligations are limited to what follows from Section 6 above and, where applicable, reimbursement of the purchase price for goods that cannot be delivered.

10. Intellectual Property

The VIKING ARM® tool and related technology are protected by international patents (including WO2019/160424 and WO2020/209731). The Viking Arm logo and the name VIKING ARM™ are registered trademarks of Viking Arm AS. All content on the Webshop, including product descriptions, images, graphics, design, and layout, is the property of Viking Arm AS and is protected under applicable copyright, trademark, and marketing law, and may not be downloaded, copied, or otherwise used without prior written consent, except as permitted by mandatory law. 11. Changes to These Terms

We reserve the right to amend these Terms, including as a result of changes in applicable legislation. The version of the Terms in force at the time you place your order will apply to that purchase.

12. Complaints and Out-of-Court Dispute Resolution

If you are not satisfied with our handling of your order or a complaint, please contact us first at support@vikingarm.com so that we can try to resolve the matter directly.

As a consumer, you may also be entitled to refer a dispute to a competent Alternative Dispute Resolution (ADR) body in your country of residence. A list of national consumer dispute resolution bodies across the EU/EEA is available at the European Commission’s Consumer Redress in the EU pages: https://consumer-redress.ec.europa.eu/dispute-resolution-bodies. Please note that the EU’s centralised Online Dispute Resolution (ODR) platform was discontinued by the European Commission on 20 July 2025 and is no longer in operation.

You may also always bring the matter before the ordinary courts, or contact a consumer protection authority in your country of residence for guidance.

13. Governing Law and Jurisdiction

These Terms and any dispute or claim arising out of or in connection with them, including non-contractual disputes, are governed by the laws of Norway.

Before commencing legal proceedings, the parties should seek to resolve the matter through direct dialogue in good faith. This does not limit any mandatory statutory rights or either party’s right to seek urgent interim measures.

For business customers, any dispute shall, to the extent permitted by applicable law, be subject to the exclusive jurisdiction of Asker and Bærum District Court, Norway.

For consumers, nothing in these Terms limits the right to bring proceedings before the courts that have jurisdiction under mandatory applicable law, including the courts of the consumer’s country of residence where applicable.

Regardless of this choice of law, if you are a consumer habitually resident in an EU/EEA member state, you continue to benefit from any mandatory consumer protection provisions of the law of your country of residence that cannot be derogated from by agreement, in accordance with Article 6 of Regulation (EC) No 593/2008 (Rome I).
